195 signed votes by Portland residents, 184 of those from North Portland, support DUE PROCESS and oppose the Bridge Meadows corporation project (see names below). Not a single signed vote has been produced opposing DUE PROCESS and supporting Bridge Meadows. Supporting DUE PROCESS and opposing Bridge Meadows are inextricably tied together as are its opposite, opposing DUE PROCESS and supporting Bridge Meadows. You can't have one without the other.

Commissioner Dan Saltzman understood from the beginning when the prediction was made that his pet project would not even make it to the bottom of any list of proposed uses arrived at through DUE PROCESS that would be acceptable to the North Portland community. He accepted the truth of this statement and so proceeded to abuse the power of his office by making a back room political deal with Tom Potter and Erik Sten to act as coconspirators by suspending DUE PROCESS and forcing his pet project through the city council while refusing then and now to even mention much less defend the deliberate dismissal of DUE PROCESS.

The testimony of Amanda Fritz and the NO votes of Sam Adams and Randy Leonard in October 2006 challenged the total lack of DUE PROCESS. Nothing has changed to negate this argument. No person has ever challenged this argument. It remains as valid today as it was in October 2006.

The hearings officer, Ian Simpson, cannot ignore the DUE PROCESS elephant in the room as it trumpets indignation and anger at being ignored.

Although this material is already on the record here is a recap of the disastrous, disreputable denial of due process:

1. In the summer of 2006 Richard Elllmyer asked staff from every member of the Portland city council to explain the due process by which the disposition of the John Ball School property would be determined. Not a single staff person had the slightest idea what the process would or should be.

2. In the summer of 2006 Richard Elllmyer, with 31 years of political activist experience, told staff from every member of the Portland city council that the process to be followed should be as follows:

A. Make a public announcement that the city of Portland will hold a series of public meetings to ask for ideas about a future use for the John Ball School site. 

B. Make a public announcement that the city of Portland will be accepting ideas about a future use for the John Ball School site by mail and email.

C. Through a public meeting process reduce to the number of proposed uses for the John Ball School property to those with the most support and most viability.

D. Submit the final choices to the Portland Planning Commission for review, comment and recommendation.

E. Bring the final choices and the Portland Planning Commission recommendation before the city council for more public testimony and a vote of the council.

3. In the summer of 2006 Richard Elllmyer told staff from every member of the Portland city council about his proposal for a planned development on the John Ball School site that would include high end, state of the art "green" single family houses, condos and a library. With the exception of the library no government subsidies would be involved in the building of this community. The development would be a social and cultural offset to the neighboring New Columbia. It would bring tax revenue to the city and disposable income to North Portland to help attract and support local businesses. 

4. In October 2006, with little or no warning, coconspirators Saltzman, Potter and Sten placed on the agenda a resolution to award the John Ball School property to the Portland Hope Meadows corporation, now Bridge Meadows corporation.

5. In October 2006 coconspirators Saltzman, Potter and Sten voted to giveaway the John Ball School property to the newly formed, inexperienced, untested Portland Hope Meadows corporation without any of the DUE PROCESS mentioned in item 2 above.

6. In October 2006 coconspirators Saltzman, Potter and Sten voted to giveaway the John Ball School property to the Portland Hope Meadows corporation without any acknowledgment whatsoever that there was already a legitimate, community supported, competing proposal on the public table that would be dismissed without consideration or comment. 

7. In October 2006 coconspirators Saltzman, Potter and Sten voted to giveaway the John Ball School property to the Portland Hope Meadows corporation without any acknowledgment or refutation of any argument made by Amanda Fritz, Sam Adams and Randy Leonard in opposition to the resolution. ALL of the arguments made by Fritz, Adams and Leonard remain valid, unchanged and unchallenged.

The putrid stench of due process death clings to this malodourus process. It cannot be ignored. To remove the stentch the voice of the people (see votes below) must be heard, the conditional use permit denied and DUE PROCESS returned to its rightful place in democratic government.
